In the News, Spring 2022: GMO Food Labeling Regulations

Mandatory compliance with federal regulations on the labeling of genetically modified foods went into effect on the first of this year. The regulations, issued by the USDA in 2018, prohibit the use of the commonly known terms genetically engineered (GE) and genetically modified organism (GMO), restricting on-packaging text to the terms Bioengineered food and Contains bioengineered ingredients.

Other disclosure options include one of four logos bearing the same central image; a QR code, which must be scanned by shoppers in order to determine that the food is or may be bioengineered; or for “small food manufacturers” or small packages, only a phone number or web address. “Very small food manufacturers” – those with annual receipts below $2,500,000 – are exempt from the labeling requirements.

A vast number of foods with bioengineered ingredients are also exempt from disclosure, including highly refined products (e.g., soft drinks and cooking oils) that do not contain detectable genetic material, and foods that are primarily meat, poultry, or egg products.

The Center for Food Safety (CFS), representing a coalition of grocers and retailers, has filed a pending lawsuit charging that the regulations are deceptive and discriminatory. Executive director Andrew Kimbrell states: “These regulations are not about informing the public but rather designed to allow corporations to hide their use of genetically engineered ingredients from their customers.”
